This Writ Petition is filed, under Article 226 of the Constitution of India, challenging the order of suspension of Fair Price Shop of the petitioner by the Revenue Divisional Officer vide proceedings Rc.No.594/2016-E, dated 27.10.2016. 2.

Heard Sri Ch.B.R.P.Sekhar, learned counsel appearing for the petitioner and learned Government Pleader appearing for the respondents.

The petitioner herein is a Fair Price Shop dealer of Shop No.03, Macherla Town and Mandal, Guntur District. Followed by registration of a case under Section 6-A of the Essential Commodities Act, and a show-cause notice, dated 05.10.2016, issued by the Revenue Divisional Officer, Gurazala, the Fair Price Shop authorization of the petitioner was suspended pending detailed further enquiry.

According to the learned counsel for the petitioner, the impugned order of suspension is unwarranted in the facts and circumstances of the case.

On the other hand, it is submitted by learned Standing Counsel that the variations pointed out in the impugned order are very high and no interference of this Court is warranted, as enquiry is pending consideration. It is also submitted by the learned Government Pleader that despite issuance of show-cause notice, the petitioner herein did not submit his explanation.

Having regard to the submissions made learned counsel for the petitioner and the learned Government Pleader, this Court is of the consideration opinion that the ends of justice would be served, if the Revenue Divisional Officer is directed to complete the enquiry, within a time frame, by giving opportunity to the petitioner herein.

For the aforesaid reasons, the Writ Petition is disposed of, directing the petitioner herein to submit explanation pursuant to the show-cause notice, dated 05.10.2016, to the Revenue Divisional Officer, within a period of two (02) weeks from today. In the event of any such explanation is filed, the Revenue Divisional Officer is directed to consider the same and complete the enquiry as expeditiously as possible.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________ A.V.SESHA SAI, J APRIL 13, 2017 YVL
