THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 11421 of 2017 ORDER:
This writ petition is filed challenging registration of Crime No.381 of 2016 by respondent No.3-Sub-Inspector of Police, Nellore Rural Police Station on a complaint filed by respondent No.4 before the learned IV Additional Judicial Magistrate of First Class, Nellore. Learned counsel for the petitioner submits that A1 and A2 already obtained bail and there is apprehension of arrest of the petitioner.
Since the crime was registered pursuant to the order of the learned Magistrate, this Court is not inclined to interdict the investigation, but, directs respondent No.3 to follow due process of law including compliance of Section 41(A) Cr.P.C. while investigating the crime.
