THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 15930 of 2002 ORDER:
This writ petition is filed seeking the following relief " to issue an order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not considering the case of the petitioner for appointment to the post of Site Supervisors, Drivers, Helpers, D.C.
Electricians, A.C.
Electricians, Crane Operators, or in any other suitable posts as per B.P.Ms.No.36 dt.18.5.1997 as illegal, arbitrary and violative to 25-H of I.D.Act, 1947 by directing the respondents to consider the case of the petitioners for regular appointments in initial recruitment cadres as per B.P.Ms.No.36 dated 18.5.1997 without disqualifying the petitioners on the ground that they crossed the age of 25 years on the date of their first engagement as Village Electricity workers and pass such other order or orders as this Hon'ble Court deem fit and proper."
When the matter is taken up for hearing, it is submitted by the learned standing counsel for the respondents that the petitioners are seeking appointments to various posts as per B.P.(P&G).Ms.No.36 dated 18.5.1997. Learned standing counsel further submitted that since B.P.(P&G).Ms.No.36 dated 18.5.1997 was withdrawn, there cannot be any direction to consider the case of the petitioners and the writ petition has become infructuous. Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs.
