HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.35351 OF 2016 ORDER:
The writ petition is filed questioning the action of the respondents 1 and 2 in not granting fire NOC to the 2nd petitioner institution. Heard the learned counsel for the petitioner, learned Government Pleader for Municipal Administration (T.G) and Sri P. Kesava Rao, Standing Counsel for the Greater Hyderabad Municipal Corporation.
It is the case of the petitioners that the 1st petitioner is a registered society formed and founded primarily to provide educational facilities to the members of the Muslim community and in furtherance of its objectives, the 1st petitioner society sought to establish a pre-primary school at Ramkote, Hyderabad. Pursuant to the same, the petitioners constructed various buildings including class rooms, administrative blocks etc. In that connection, the petitioners applied to the 4th respondent Board for grant of affiliation for the 2nd petitioner institution for the academic year 2016-17. It is stated that the 2nd petitioner institution building was constructed after meeting all the fire safety requirements and pursuance of the same, the petitioners formally applied to the 1st respondent for the grant of fire NOC on 09.08.2016, but the 2nd respondent is not taking any steps to issue the said NOC, so far. Hence, the present writ petition.
Learned counsel for the petitioners submits that even though the petitioners applied for grant of fire NOC on 09.08.2016, the respondents did not take any action so far and hence he prays to allow the writ petition as prayed for.
Considering the fact that the application of the petitioners dated 09.08.2016 is pending with the 2nd respondent, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the same within a period of two weeks from the date of receipt of copy of this order. Till such
time, the orders are passed on the application of the petitioner, the 2nd respondent shall not take any coercive steps against the petitioners. With the above observations, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
