THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 488 of 2018 O R D E R :

The Contempt Case has been filed complaining wilful and deliberate disobedience on the part of the respondent of the order dated 18.09.2017 in Writ Petition No. 31427 of 2017. This Court, while disposing of the Writ Petition, directed that the representation of the petitioner dated 22.08.2017, which, admittedly, was received by the 3rd respondent, should be considered and processed in terms of the guidelines notified by the Indian Oil Corporation Limited.

Today, Sri Mayur Reddy, learned Standing Counsel for Indian Oil Corporation Limited has placed on record the note dated 08.02.2018 issued by the Corporation, wherein it has been stated that the Application of the petitioner was once again scrutinized and it was found not eligible for the RO dealership for the location "Between Nirmal Town on Bhainsa Road within 2 K.M. from Shivaji Statue on RHS, District Adilabad" for the reason that the petitioner does not have minimum fund of Rs. 25 lacs in his name as on the cut-off date for submission of application. It was further stated that the funds were shown in the name of the petitioner's father, who does not fit into the definition of 'family' as mentioned in the Dealership Selection Guidelines Brochure.

This aspect of the matter has not been disputed by the learned counsel for the petitioner. In those circumstances, the Contempt Case is closed.

Consequently, the miscellaneous Applications, if any shall stand closed.
