HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI AND HON'BLE SMT JUSTICE G.ANUPAMA CHAKRAVARTHY W.P.Nos.29030, 29729, 29734, 29791, 29811 & 30050 OF 2013 COMMON ORDER: (Per Hon'ble Sri Justice Abhinand Kumar Shavili) Since the issue involved in all these writ petitions is one and the same, they are being heard together and disposed of by way of this common order.
It is the case of the petitioners that the respondents are working as NMR workers and when their services were regularized with prospective effect, they have filed O.A.No.9702 of 2011 and batch contending that their services should be regularized from the date on which they have completed five years of service. The Tribunal vide order dated 26.06.2012 allowed the said batch of cases. Aggrieved by the same, the present writ petitions are filed.
Learned counsel appearing for the petitioners as well as learned Government Pleader for Services-I appearing for the respondents had fairly conceded that the issue involved in all these writ petitions is squarely covered by the decision rendered by the Apex Court in B.Srinivasulu v. Nellore Municipal Corporation1, and also common order dated 02.05.2018 passed 1 Civil Appeal No.6318 of 2015 decided on 17.08.2015
by Division Bench of this Court in W.P.No.33936 of 2011 and batch.
Following the decision of the Apex Court in B.Srinivasulu v. Nellore Municipal Corporation and also the common order dated 02.05.2018 passed by the Division Bench of this Court in W.P.No.33936 of 2011 and batch and for the reasons alike, all the writ petitions are disposed of directing the petitioners to consider the cases of the respondents by duly taking into consideration the above said judgments and pass appropriate orders in accordance with law. It is needless to say that the respondents are entitled to only notional benefits, without any monetary benefits. No costs.
