HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P. No.777 of 2015 ORDER:

This petition is filed to withdraw O.P.No.19 of 2015 from the file of Family Court-cum-VII Additional District Judge, Medak at Sanga Reddy, and transfer the same to Family Court, Hyderabad.

2. Wife filed this petition. According to her affidavit, her marriage with respondent took place on 31.05.2013 at Hyderabad and respondent is related to her and due to differences, the marriage was not consummated and they are living separately and respondent filed O.P.No.966 of 2014 for restitution of conjugal rights, subsequently it was dismissed, and that she filed D.V.C.No.150 of 2014 before III Additional Special Judge, Hyderabad at Erramanzil, and respondent filed O.P.No.19 of 2015 at Sanga Reddy. She further stated that she is working as software engineer at Hyderabad and living with her parents and it is difficult for her to travel from Hyderabad to Sanga Reddy to defend O.P.No.19 of 2015 because of her employment, therefore, prayed for transfer of O.P.No.19 of 2015 from Sanga Reddy to Hyderabad.

3. Respondent filed counter disputing the affidavit averments of petitioner and contended that petitioner is employee whereas respondent has no employment and if the case is transferred, it is difficult for him to travel from

Sanga Reddy to Hyderabad.

4. Heard both sides.

5. Advocate for respondent submitted instead of Family Court, Hyderabad, the case may be transferred to Family Court, Secunderabad.

6. Considering the submission of both sides and contentions and rival contentions of both parties, O.P.No.19 of 2015 is withdrawn from Family Court-cumVII Additional District Judge, Medak at Sanga Reddy, and transferred to Family Court, Secunderabad, for disposal in accordance with law.

7. Accordingly, transfer C.M.P. is ordered.

8. Miscellaneous petitions pending, if any, shall stand closed.
