THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Tr.Crl.P.No.80 OF 2016 ORDER:

This petition is filed to withdraw S.T.C.No.24 of 2015 from the file of Judicial Magistrate of First Class, Jammalamadugu and transfer the same to any Court at Hyderabad having competent jurisdiction.

2. The 2nd respondent/defacto complainant filed S.T.C.No.24 of before the Judicial Magistrate of First Class, Jammalamadugu under Section 190 and 200 of Cr.P.C for dishonour of cheques.

Learned counsel for the petitioner submitted that the petitioner has serious threat to his life at Jammalamadugu and that he shifted his residence from Jammalamadugu about 12 years back. It is also submitted that the 2nd respondent has obtained the signatures of the petitioner on blank cheques and that the 2nd respondent is an influenced person at Jammalamadugu. For these reasons, he prayed for transfer of S.T.C. 24 of 2015 from the file of Judicial Magistrate of First Class, Jammalamadugu to any Court at Hyderabad having competent jurisdiction.

4. having heard learned counsel for the petitioner, perused the material available on record.

5. In view of the facts and circumstances of the case, I do not see any grounds to transfer S.T.C.No.24 of 2015 from the file of

MSKJ,J Judicial Magistrate of First Class, Jammalamadugu to Hyderabad. However, taking into consideration of the apprehension of the petitioner, Judicial Magistrate of First Class, Jammalamadugu is directed to dispose of S.T.C. 24 of 2015 within six months from the date of receipt of a copy of this order, without insisting for the presence of the petitioner on each and every date of hearing unless his personal appearance is required. The petitioner shall make arrangements for proper and effective representation during the course of trial and shall not seek any adjournment.

6. Accordingly, the Transfer Criminal Petition is disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
