THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CIVIL REVISION PETITION No.969 of 2019 ORDER:

This Revision is filed challenging the order dt.15-03-2019 of the Principal Junior Civil Judge, Medchal, Ranga Reddy District in O.S.No.773 of 2006 refusing to adjourn the matter, closing the arguments of the petitioner/plaintiff and reserving the matter for pronouncement of judgment.

2.

The e.Courts status print out produced by the petitioner itself shows that matter was posted for addressing arguments by the petitioner on 06-02-2019, 14-02-2019, 20-02-2019, 28-02-2019 and 15-03-2019. In spite of giving the above opportunities, learned counsel for the petitioner in the Court below has not addressed arguments on the pretext that 3 I.As. had been rejected by the Court below and C.M.As. were preferred against them. So it is clear that the petitioner did not cooperate with the Court below for disposal of the suit. When the petitioner has not cooperated with the Court for disposal of the suit, the petitioner cannot complain that opportunities were denied to the petitioner to address arguments because such contention is not borne out of record.

3.

I therefore see no error in the order passed by the Court below warranting interference by this Court under Article 227 of the Constitution.

MSR,J C.R.P.No.969 of 2019 4.

The Civil Revision Petition fails and it is accordingly dismissed at the stage of admission. No costs.

5.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
