THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2384 OF 2018 ORDER:
This petition is filed by the petitioners-A1 and A6 under Section 482 Cr.P.C. to quash the proceedings in C.C.No.527 of 2017 on the file of the XIII Addl. Chief Metropolitan Magistrate (Mahila Court), Hyderabad, wherein cognizance was taken for the offences punishable under Sections 323, 420, 498-A and 506 IPC.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

It is contended by the learned counsel for the petitioners that C.C.No.527 of 2017 ended in acquittal of some of the accused, wherein the de facto complainant compromised with them.

Admittedly, these petitioners did not face the trial. Whether the evidence recorded in the impugned C.C. applies to the instant case or not has to be decided by the Court below. The petitioners have remedy available before the Court below to agitate all the defences put forth here and seek appropriate relief.

With the above observation, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
