HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 37539 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring that a) the action of the respondents in not releasing pension and pensionary benefits to the petitioner, in pursuance of his retirement dated 31.1.2012 as illegal, arbitrary and discriminatory; b) declare that the petitioner is entitled for release of his pension and pensionary benefits forthwith; c) to declare that the respondents have no power to withhold the pension and retiremental benefits payable to the petitioner.

Counter affidavit is filed by the 3rd respondent stating that if the petitioner is entitled for any of the retirement benefits on his retirement, after the date of his retirement, the other respondents 1, 2 & 4 are liable to pay him as he was employee of the 1st and 2nd respondent department. Heard learned counsel for the petitioner and learned Assistant Government pleader for Services-I appearing for respondents 1 and 2.

Learned Assistant Government Pleader for Services-I basing on the counter affidavit of the 3rd respondent submits that pension of the petitioner will be released. In view of the averments in the counter affidavit filed by the 3rd respondent and also in view of the submission of the

learned Assistant Government Pleader for Services-I, this writ petition is disposed of directing the respondents to release the pensionary benefits as per Rules in force, within a period of three months from the date of receipt of a copy of this order.

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
