The present petition is filed seeking temporary return of passport deposited with the XII Additional Chief Metropolitan Magistrate, Hyderabad, pursuant to the orders passed by the II Additional Metropolitan Sessions Judge, Hyderabad on 3.8.2015 in Crl.M.P.No. 2323 of 2015 in Crime No. HQPOR No. 22/2015-State VII. Service Tax Commissionerate, Hyderabad for the alleged offences punishable under Section 73 (A) of Finance Act and under Sections 193 & 228 of IPC.

Heard Sri B. Chandrasen Reddy, learned counsel appearing for petitioner/accused and Sri B. Narasimha Sarma, learned Special Public Prosecutor appearing for respondent.

Learned counsel appearing for petitioner has pointed out the orders passed by this Court in Criminal Petition No. 8337 of 2016 dated 14.6.2016 and in Criminal Petition No. 14910 of 2016 dated 17.10.2016, whereby and whereunder, the petitioner was permitted to take the passport from the learned XII Additional Chief Metropolitan Magistrate, Hyderabad, and resubmit it after the purpose mentioned therein was over by fixing the dates also. One of such orders, which is in Criminal Petition No. 14910 of 2016, would show that the petitioner was directed to surrender his passport by 25.1.2017 and the petitioner having returned from abroad re-deposited his passport on 23.1.2017. 4.
Now, the learned counsel appearing for petitioner submits that in the light of an invitation dated 19.1.2017 sent by Sans Souci Capital
Corporation, the petitioner is required to attend the meetings on technical and financial aspects of MOU between 15.2.2017 and 28.2.2017.

Learned Special Public Prosecutor, while expressing his no objection has pointed out the memo filed by the petitioner on 29.10.2016.

In view of the aforesaid submissions Criminal Petition is allowed directing the learned XII Additional Chief Metropolitan Magistrate, Hyderabad to return the passport to the petitioner and the petitioner is also directed to surrender his passport by 6.3.2017.
