HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.14764, 14674 and 14673 of 2016 COMMON ORDER:
Crl.P.Nos.14764, 14674 and 14673 of 2016 are filed by accused Nos.17, 18 and 19, under Section 438 Cr.P.C, seeking release in the event of their arrest in connection with Crime No.115 of 2016 of Kodad Police Station, Nalgonda registered for the offences punishable under Sections 406, 420, 468 and 471 read with 34 IPC.
The averments in the report would disclose that the Branch Manager of SPGV Bank, Main Branch at Kodad lodged a report stating that A.1 to A.16, who were the borrowers of agricultural loans from SBH, Kodad and APGV bank Main Branch at Kodad, colluded with A.17 to A.19 and hatched a plan for wrongful gain by creating fabricated pass books and title deeds. It is alleged that A.17 created fabricated documents in the name of A.13 and his parents and obtained crop loan from SBH, Kodad and APGV bank Main Branch at Kodad. It is alleged that, similarly, A.18 and A.19 also created fabricated documents and obtained crop loans from banks. Based on these allegations, the aforesaid crime came to be registered. The only argument advanced by the learned counsel for the petitioners is that, since A.1 to A.16 were released on bail, the request of petitioners - A.17 to A.19 may also be considered. Learned Additional Public Prosecutor opposed grant of bail to the petitioners.
The argument of the learned counsel for the petitioners cannot be accepted for the reason that A.1 to A.16 are borrowers whereas the petitioners - A.17 to A.19 are the persons who created fabricated documents, obtained loans by playing fraud on borrower. Thus, I am not inclined to grant bail to the petitioners. However, the petitioners are at liberty to surrender before the Court below and move an application seeking bail, in which event, the bail application of the petitioners shall be considered in accordance with law.
