W.P.No.44941/2016 WRI T PETI TI ON No.44941 of 2016 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioner has come up with the above writ petition challenging a notice dated 9.11.2016 issued by the bank.

Heard Mr. M. Ganga Rao, learned counsel appearing for the petitioner. Mr. A. Krishnam Raju, learned counsel takes notice for the 1st respondent-Bank.

At the out set, what is challenged in the writ petition is only a notice issued prior to the sale. The Bank has not issued an auction sale notice in terms of Rule 8(6). Therefore, the petitioner has no cause of action as on date.

In any case, the petitioner should approach only the Tribunal, even if a sale notice is issued hereafter. Therefore, with the above liberty, this writ petition is dismissed. 5.
