Pralayakaveri Venkata Ramanamma v. The District Collector
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 20845 of 2012 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Revenue appearing for respondent Nos.1 & 2 and learned Government Pleader for Home appearing for the 3rd respondent. With the consent of the parties, the writ petition is heard and disposed of at the admission stage itself. The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of respondent Nos.1 and 2 in not considering the representation dated 24.04.2012 made by the petitioner seeking enquiry, and in proceeding against her without giving any opportunity with regard to change of her name in the revenue records in respect of land to an extent of Acs.4.10 cents in Survey No.568 situated at Mocherla Village, Gudlur Mandal, Prakasam District, as illegal and arbitrary.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to respondent Nos.1 and 2 to give an opportunity of hearing to the petitioner before effecting any change in her name in the revenue records. The learned Government Pleader for revenue submits that the petitioner and respondent Nos.4 and 5 have approached the civil Court for redressal of their grievance, but however, due process will be followed before effecting any change in the name of the petitioner in the revenue records. Having regard to the submissions made and without going into the merits of the case, the Writ Petition is disposed of, directing respondent Nos.1 and 2 to give an opportunity of hearing to the petitioner before effecting any change in her name in the revenue records in respect of land to an extent of Acs.4.10 cents in Survey No.568 situated at Mocherla Village, Gudlur Mandal, Prakasam District. There shall be no order as to costs.
Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed.
