HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6183 OF 2018 ORDER:

This writ petition is filed challenging the action of respondents 2 to 4 in trying to dispossess the petitioners from their lands i.e., Ac.0.30 guntas in Sy.No.154/A, Ac.0.37 1⁄2 guntas in Sy.No.154/A, Ac.0.15 guntas in Sy.No.157/Ru, Ac.0.14 guntas in Sy.No.157/Lu, Ac.0.15 guntas in Sy.No.157/Ru situated at Raghunadhagudem Village, Kalluru Mandal of Khammam District without following due process of law. After adjourning the matter on 26.02.2018, when the matter is taken up today, the learned Government Pleader, produced before this Court, written instructions, stating that the policy of double bedroom houses were sanctioned to the weaker section people in the Village by the District Collector, Khammam on 05.05.2017. The vacant site available in Gramakantham (village site) was proposed for construction of houses.

The construction work is being taken up by the Government without interfering with and touching the possession of the writ petitioners over their patta lands. Respondents never interfered with the petitioners' lands and the land earmarked for construction of the houses is in no way concerned with the patta lands of the petitioners. In view of the submissions made by the learned Government Pleader for the respondents there is no basis for the apprehension of the petitioners. The Writ Petition is, accordingly, closed by recording the statement of the learned Government Pleader. No costs.
