THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Petition No.6214 of 2018 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The relief sought for in this Writ Petition is to declare the action of respondents 2 to 10 in not initiating any preventive action on the petitioner's representation dated 14.04.2017 submitted for removal of hazardous public nuisance and sound pollution being caused by the 11th respondent from his illegal construction called "New Grace Pentha Coast Church being operated from his residence, as illegal, irregular, irrational and violative of provisions of the Greater Hyderabad Municipal Corporations Act; Andhra Pradesh (Andhra Area) Public Health Act, 1939 and the provisions of Noise Pollution (Regulation and Control) Rules, 2000 issued under Environment (Protection) Act, 1986.
The petitioner submitted a representation on 15.03.2017, a copy of which is enclosed along with the Writ Petition. While the Learned Government Pleader for Home, on instructions, submits that no such representation was filed, it is wholly unnecessary for us to delve on this issue as it would suffice if, on the representation dated 15.03.2017 enclosed to the Writ Petition, the Superintendent of Police, Guntur, is directed to cause an enquiry into the matter; examine whether the 11th respondent Church is causing noise pollution to the residents of the apartment in which the petitioner is residing, and pass necessary orders in accordance with law. The entire exercise, culminating in an order being
passed by the Superintendent of Police, Guntur, and in communicating the same to the petitioner, shall be completed within a period of three weeks from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
