HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24742 of 2011 ORDER:

This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the respondents in interfering with the business rights of the petitioner for conducting online booking of tickets by insisting upon a separate licence as illegal and arbitrary, and consequently, direct the respondents not to interfere with the business of the petitioner. The main grievance of the petitioner is that respondents are interfering with the online selling of the tickets by the petitioner. Heard and perused the material available on record. On 08.09.2011 while admitting the writ petition, this Court passed an interim order in WPMP No.30419 of 2011 directing respondents not to interfere with the petitioner's sale of tickets on their web site provided that the tickets are actually issued at the counters in the premises of the petitioner's theatres.

Learned counsel for the petitioner submitted that now-a-days, in view of the latest developments, cinema tickets are being sold through online.

Considering the facts and circumstances of the case and the interim order passed by this Court on 08.09.2011 in W.P.M.P.No.30419 of 2011 is made absolute and respondents are directed not to interfere with the business of the petitioner.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
