The Criminal Revision Case is filed aggrieved by the Order dated 11.03.2008 in Crl.M.P.No.810 of 2008 in C.C. No.265 of 1999 on the file of Chief Metropolitan Magistrate at Hyderabad, wherein an application was filed by the revision petitioner under Section 319(1)(2) of the Code of Criminal Procedure for impleading the proposed accused and to issue summons to the proposed accused, was dismissed.
02. No representation on behalf of the petitioner as well as respondent No.1. Sri Khaja Vizarath Ali, learned Assistant Public Prosecutor for the Respondent No.2/State is present.
03. Even on earlier occasion also, there was no representation from the petitioner. Even today, when the matter is posted under the caption "for dismissal", there is no representation on behalf of the petitioner and it appears that the petitioner is not interested in prosecuting the case. o4 In view of the above, this Criminal Revision Case is liable to be dismissed.
05. Accordingly, this Criminal Revision Case is dismissed for non-prosecution.
As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
