O R D E R

The case of the petitioners is that they are the residents of the colonies abutting both sides of the road from Gopalapuram circle to Devannapet village via Kallu Manduva Junction (Jawahar Colony junction), Komatipally village and Railway Gate, Bheemaram Hasanparthy mandal, Warangal Urban District, and they purchased the subject properties under registered sale deeds, and have been in peaceful possession and enjoyment. Their grievance is that the respondents have marked portions in their properties for demolition for the purpose of road widening, without issuing any notice and following the procedure prescribed under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013). Hence, the writ petition. Heard the learned counsel for the petitioners.

Learned Government Pleader for Municipal Administration and Smt. Pingali Lakshmi, learned Standing Counsel appearing for 3rd respondent - Municipal Corporation, on specific instructions, submit that as on date, there are no proposals to acquire the subject land for the purpose of road widening, as stated by the petitioners, and that if the respondents intend to undertake the process of road widening, they will follow the due process of law.

Recording the above submission of the learned counsel appearing for respondents 2 and 3, writ petition is disposed of directing the respondents

not to interfere with the possession of the petitioners over the subject property, without following due process of law. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
