Kollipara Narasimharao, v. The State Of Andhra Pradesh,
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34997 of 2016 ORDER:
1.
This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings in C.C.No.83 of 2015 on the file of the Additional Judicial First Class Magistrate, Avanigadda, Krishna District.
2.
Heard and perused the material available on record. 3.
From the material on record, it is apparent that the on the basis of the complaint lodged by the 3rd respondent, the 2nd respondent filed the charge sheet in the above C.C. after due investigation. When judicial proceedings are pending before the Court, this Court is not inclined to exercise the writ jurisdiction particularly, under Article 226 of the Constitution of India. The petitioners are left with the remedy of Section 482 Cr.P.C and they can also approach the Court concerned by way of filing discharge application, if they so desire. Without exhausting alternative remedies, the petitioners approached this Court. This Court is not inclined to pass any orders in this petition. 4.
Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. _________________ RAJA ELANGO, J Date: 18th October, 2016 Nn
