Petitioner claims that his grand father Deepangi Ramaswamy was granted patta in respect of agricultural lands to an extent of Ac.3-25 guntas in Sy.No.262/34 and Ac.3-16 guntas in Sy.No.262/15 of Sarapaka Village, Burgampahad Mandal, Bhadradri Kothagudem District. For several years, family of the petitioner is in possession and occupation of the above extents of land. Petitioner alleges that land to an extent of Ac.3-25 guntas in Sy.No.262/34 is handed over to ITC (Bhadrachalam Paper Boards) Limited without following due process and the same is illegal. In support of the plea that petitioner is the owner, counsel for petitioner placed reliance on the report of Mandal Surveyor showing that this piece of land belongs to petitioner. Petitioner also placed on record pahanies in support of the claim. On 03-03-2016 a detailed representation was made explaining the ownership claim of the petitioner and pointing out illegal handing over of possession of private land belonging to the petitioner to ITC Limited without following due process.

Petitioner, therefore, sought for payment of compensation in accordance normal procedure for payment of compensation of acquiring private land or to assign him alternative land in the same village or any other village. As mentioned, petitioner claimed to have followed up the same by further representation on 06-06-2018 and 15-03-2019. Alleging inaction, this writ petition is filed.

02. Since representations are made ventilating his grievance, this Court is not expressing any opinion. Suffice to know that several aspects are mentioned in the representations. The District Collector shall examine the claim of the petitioner as ventilated in representations, referred to above and take decision on the validity of the claim made by the petitioner and pass orders assigning due reasons in support of his decision, within a period of eight weeks from the date of receipt of a copy of this order.

03. Accordingly, the writ petition is disposed of. Pending miscellaneous petitions shall stand closed.
