This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused in Crime No.8 of 2024 before the Maddur Police Station, Narayanpet District, Telangana State, registered for the offences punishable under Sections 409 and 420 of IPC. 2.

The brief facts of the case are that on 11.01.2024 at 12:00 hours, a complaint was lodged by Sri Ranjith Gundoji,

Branch Manager, APGVB Gundumal Branch, alleging that Smt. Kothuru Radhika, appointed as Bank Mitra in Bhuneedu village, misappropriated an amount of Rs. 7,18,000/- pertaining to 120 members of 12 groups by diverting clients' money for her personal use instead of crediting it to their bank accounts. Based on the said complaint, a case was registered against her for offences under Sections 409 and 420 IPC.

Heard Sri Challa Srinivas Reddy, learned counsel for petitioner, and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated. He contended that no incriminating material is available against her, and even the internal audit did not reveal any irregularities. He averred that the allegations in the FIR are baseless and motivated by malice, and the Petitioner has cooperated with the investigation. Therefore, he prayed the

Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioners, and contended that the allegations against the Petitioner are serious in nature, involving misappropriation of public money collected from several clients. Therefore, he prayed the Court to dismiss the criminal petition. 6.

Having regard to the rival submissions and material on record, it is noted that the crime was registered in the year 2024, and the investigation has substantially progressed. The Petitioner has cooperated with the investigation and no further custodial interrogation appears necessary. Therefore, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Maddur Police Station, Narayanpet District, Telangana, within two weeks from today, and on such surrender, the said Station House Officer

shall release them on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

iv.

The petitioner shall not tamper with evidence or influence witnesses in any manner during the course of investigation or trial.

v.

The petitioner shall not leave the jurisdiction of the concerned Court without prior permission until the filing of the charge sheet.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
