HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 23545 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the 2nd respondent to fix the pay of the petitioner by allowing all benefits including notional increments for out of employment period and pay arrears from the date of reinstatement. When the matter is taken up for hearing, learned counsel for the petitioner and learned standing counsel for respondent corporation have fairly conceded that the issue raised in the writ petition is squarely covered by the judgment of the Apex Court in A.P.S.R.T.C. Vs. S. Narsagoud1 and in view of the said judgment, the petitioner is entitled for notional increments and, therefore, prayed that similar orders may be passed in the present writ petition. Following the judgment of the Apex Court referred to supra, the writ petition is disposed of and the petitioner is entitled for notional increments, in accordance with the rules.

Consequently, miscellaneous petitions pending in the writ petition, if any, shall stand closed.
