HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.21663 OF 2017 ORDER:

Heard learned counsel for the petitioners and learned standing counsel for the second respondent.

The first petitioner society established the second petitioner institution for imparting training in MCA course. It also established a PG college, decree college and PG college for MBA. It was established in Karimnagar town and District. Earlier the institutions are affiliated to Kakatiya University, Warangal and after establishment of Satavahana University in Karimnagar in 2008, Satavahana University has started according affiliation in respect of graduate and post graduate courses from the academic year 2010 onwards. The said Satavahana University was according affiliation to professional courses for MCA and MCA as well.

As per the Regulations of the All India Council for Technical Education (AICTE), in order to change the affiliating University by the institution, the institution shall obtain 'No Objection Certificate' (NOC) from the University, where the institution was affiliated and also shall obtain NOC from the University, where the institution seeks affiliation, accompanied by a resolution of the University for changing affiliation of the University. The first petitioner passed a Resolution seeking to change the affiliating University. They obtained NOC from the third respondent. The first petitioner approached the second respondent seeking issuance of NOC and paid the requisite amount also. When no action was taken by the second respondent and when a new procedure was prescribed in February, 2017, the first petitioner complied with the same also.

In spite of the same, when the second respondent has not taken any action, the present writ petition is filed.

In view of the above facts, without going into merits of the case, this writ petition is disposed of directing the second respondent to consider the request of the first petitioner for issuance of NOC to enable the first petitioner to change the affiliating University for MCA courses and pass appropriate orders, within a period of one week from the date of receipt of copy of this order.
