HON'BLE SRI JUSTICE S.V. BHATT W.P. No.32059 OF 2015 ORDER:

Heard Mr.N.Aswartha Narayana for petitioners and the learned Assistant Government Pleader for respondents. The prayer of petitioners substantially is against the proposal of respondents to dispossess the petitioners from subject land without recourse to law. The petitioners claim to have purchased the petition land through sale deed dated 25.01.2012. According to them, the respondents are under obligation to follow the procedure to acquire land or title in the petition land or at least while dispossessing the petitioners.

The 4th respondent filed counter affidavit explaining the history of subject survey numbers and according to 4th respondent the alienation in favour of petitioners attract the prohibition in A.P. Assigned Lands (POT) Act, 1977. The 4th respondent further goes on record that after finalisation of proposals, if at all the assignment is to be cancelled or possession of petitioners is interfered with, the same will be in accordance with law. The statement is placed on record and the writ petition is disposed of accordingly. No order as to costs.
