HONOURABLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10954 of 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief:

" to issue a writ, order or direction more particularly one in nature of Writ of Mandamus declaring the action of Respondents 2 and 3 in continuing the suspension of Petitioner's authorization in pursuance of Proceedings Rc.D1CS/ 2360/ 2016 dt.08-11-2016 issued by Respondent No.3 there by suspending petitioner's authorization with respect to Fair Price Shop No.3, Gooty Town, Anantapur District as illegal, arbitrary and consequently direct the Respondents to restore petitioner's authorization with respect to Fair Price Shop No.3, Gooty Town, Anantapur District."

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

The petitioner is a Fair Price Shop dealer in respect of Shop No.3 of Gooty Town, Anantapur District. The Revenue Divisional Officer, Anantapur - 3rd respondent vide proceedings in Rc.D1CS/ 2360/ 2016 dated 08-11-2016, issued show cause notice cum suspension order to the petitioner asking him to show cause as to why his authorization should not be cancelled. In response to the same, the petitioner submitted explanation on 16.11.2016.

According to learned counsel for the petitioner, despite considerable length of time, no final orders have been passed by the 2nd respondent and because of the same, the petitioner is sustaining heavy loss and injury.

Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court is of the considered opinion that the ends of justice would be served if the 2nd respondent is directed to pass appropriate orders pursuant to the show cause notice cum suspension order.

Accordingly, the Writ Petition is disposed of directing the Revenue Divisional Officer, Anantapur - 2nd respondent is directed to pass appropriate orders pursuant to the show cause notice cum suspension order, dated 08.11.2016, by taking into consideration the explanation offered by the petitioner on 16.11.2016, after giving notice and opportunity of hearing, to the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs. _______________ A.V. SESHA SAI, J April 25, 2017 KTL
