ORDER:

Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue (Andhra Pradesh) appearing for the respondents.

2. Though the writ petition is filed urging various grounds, learned counsel for the petitioners seeks to give a direction to the respondents to dispose of the representation, dated 17.12.2010, made by the petitioners at the earliest.

3. The writ petition is filed seeking to issue a writ of Mandamus to declare the action of the respondent authorities in not returning the remaining land after allotment of house sites to others over the land in an extent of Ac.4.44 cents in Sy.No.97/2 of Peramana Village, Atmakur Mandal, SPSR Nellore District, which was acquired earlier, as illegal and arbitrary, and consequently, to direct the respondent authorities to return the remaining land out of Ac.4.44 cents in Sy.No.97/2 of Peramana Village, Atmakur Mandal, SPSR Nellore District.

4. Learned Assistant Government Pleader for Revenue stated that he has no instructions as to whether the said representation is still pending or not.

5. Without going into the merits of the case and having regard to the facts and circumstances of the case, the Writ Petition is disposed of by directing respondent No.3 - The Tahsildar, Atmakur Mandal, Atmakur, SPSR Nellore District to dispose of the representation, dated 17.12.2010, of the petitioners with regard to the lands in Sy.No.97/2 of Peramana Village, Atmakur Mandal, S.P.S.R. Nellore District, if the same is still pending, within a period of four (4) weeks from the date of receipt of a copy of this order. It is needless to say that if the said representation is not already disposed of, the petitioners are at liberty

to make a fresh representation. There shall be no order as to costs.

6. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
