HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.773 of 2010 JUDGMENT:

This appeal is preferred against order dated 09.08.2010 in I.A.No.1223 of 2008 in A.S.No.45 of 2008 on the file of I Additional District Judge, Vizianagaram.

2. I.A.No.1223 of 2008 is filed for grant of temporary injunction pending disposal of the appeal and that application was allowed through impugned order dated 09.08.2010. Questioning the same, present appeal is preferred.

3. Advocate for respondent submitted according to his instructions, the main appeal itself is disposed of and nothing survives in this appeal and the appeal has become infructuous.

4. As per the office note, A.S.No.45 of 2008 was disposed of on 14.12.2012. So, in view of the disposal of the appeal, nothing survives in this matter for adjudication.

5. Hence, this appeal is dismissed as infructuous. No costs.

6. Miscellaneous petitions pending, if any, shall stand closed.
