CVNR, J CC 2161/2016 ORDER:

This contempt case is filed alleging wilful disobedience of order dt.23.11.2015 in W.P. No.17430 of 2014 whereby this Court has directed the respondent to get the survey conducted in order to know whether the properties of the petitioners fall within the Full Tank Level (FTL) of Errakunta Tank, Lalaguda Village.

In the counter affidavit filed on behalf of the respondent, it is inter alia stated that in pursuance of the order of this Court dt.23.11.2015 a joint survey was held and a joint survey report was also prepared which revealed that the property falls within the FTL of Errakunta Tank. The copies of intimation and the joint survey report are filed in support of this plea. No reply affidavit is filed controverting the said averment. Therefore, the grievance with which the petitioners filed the contempt case stood redressed. If the petitioners feel aggrieved by the survey, they shall be free to avail the remedies available to them under law.

The contempt case is accordingly dismissed.
