THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.26692 OF 2017 Dated:10.08.2017 Between:

Smt. Bandi Laxmi Devi, W/o. Late Kanthaiah, aged Abouted 74 years, Occ: Household, R/o.H.No.22-2-17, Nehrunagar, Palvoncha Town and Mandal, Bhadradri Kothagudem District .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat Hyderabad and others .. Respondents The Court made the following:

THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.26692 OF 2017 ORDER:

Petitioner claims that he belongs to Scheduled Caste Community and landless poor. Husband of the petitioner was assigned Government land to an extent of Acs.5.00 in Survey No.817 of Palvoncha Revenue Village and Mandal, Khammam District. Grievance of the petitioner is that the revenue records are altered and names of respondents 5 and 6 are reflected in Adangals/pahanies. Aggrieved thereby, petitioner submitted representation on 12.05.2017 to the Revenue Divisional Officer, Kothagudem, the 3rd respondent, requesting to rectify the entries made in the revenue records. Alleging inaction on the said representation, this Writ Petition is filed.

2.

What is contended by the petitioner amounts to raising an objection on corrections carried out by the competent authority. Section 5 (5) of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short, 'the Act') provides remedy of appeal against corrections made in the revenue records. Petitioner has not availed the said remedy and submitted the representation. If an appeal is filed now, petitioner has to array the parties in whose name the revenue records are altered and the appellate authority should cause notice to them and then decide the issue after hearing the parties. Thus, the petitioner ought to have preferred an appeal instead of making a representation. 3.

The Writ Petition is accordingly dismissed granting liberty to the petitioner to avail the remedy of appeal against the alleged

corrections made in the revenue records. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
