The transfer criminal petition is filed seeking to withdraw MC.No.36 of 2015 on the file of the Judicial First Class Magistrate, Kaikalur, Krishna District and to transfer to Judicial First Class Magistrate, Eluru, West Godavari District.

Heard the counsel for the petitioner, the counsel for the second respondent and the learned Public Prosecutor appearing for the first respondent.

The ground on which transfer of MC.No.36 of 2015 is sought for is that OP.No.168 of 2016, which is filed for divorce by the petitioner, is pending on the file of the Eluru Court.

The counsel for the respondent submits that since the respondent is residing in Krishna District, it would be convenient for her, if OP.No.168 of 2016 is transferred to the Court of Judicial Magistrate of First Class, Kaikalur, Krishna District. 5.

Since the petitioner is stated to be residing in Bangalore, it would be convenient for both the parties to have the two cases tried by Judicial First Class Magistrate, Kaikalur, Krishna District.

Hence, OP.No.168 of 2016 is transferred to the file of Judicial First Class Magistrate, Kaikalur, Krishna District to be tried along with MC.No.36 of 2015.

The transfer criminal petition is disposed of with the above direction. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
