THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 96 OF 2013 ORDER:

This Writ Petition is filed to declare the action of respondent No. 2 in issuing letter dated 02-02-2011 as illegal and arbitrary. 2.

The case of the petitioner is that only on the ground of pendency of vigilance case against it, its request for registration as Class-II (Civil) Contractor is not considered by respondent No. 2.

At the hearing, learned standing counsel for respondent No. 2 submits that registration as Class-II (Civil) Contractor will be given for a period of five years at a time and after the said period of five years, a fresh application has to be filed. Learned standing counsel further submits that the impugned order is passed pursuant to the application filed by the petitioner in the year 2010 and that the period for which the petitioner asked for registration has expired in 2015.

In view of the fact that the application of the petitioner is of the year 2010 and as it applied for registration for a period of five years which is already over, it is open to the petitioner to file a fresh application before respondent No. 2 for registration as Class-II (Civil) Contractor.

The Writ Petition is disposed of accordingly. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
