HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37247 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash Crime No.273 of 2016 on the file of the 2nd respondent.

Heard and perused the material available on record. 3.
It is the grievance of the petitioner that the petitioner is doing business of purchase of all types of pulses from farmers and selling the same to the traders. On 8.10.2016, there was a press meet by the President of Rice Association of their town and on that day, statements were given against the commercial tax office staff and also C.T.O. On that, the CTO bore grudge against the petitioner and foisted the present case against the petitioner.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the circumstances of the case, this Court is of the view that the investigation can be completed without arresting the petitioner.

Accordingly, respondents Nos.1 and 2 are directed to complete the investigation and file a final report in the above Crime, in accordance with law, without arresting the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
