B/O RRB 09.12.2021 LK,J I.A.NO.3 OF 2021 Petitioner/A-2 filed this application to relax the condition imposed by this Court by order dated 29.04.2021 whereby the petitioner was directed to appear before the investigating officer on every second and fourth Saturdays between 10.00 am and 5.00 pm till completion of investigation.

Learned counsel for the petitioner/A-2 submits that petitioner has been complying with all the conditions of the bail orders of this Court and has been regularly appearing before the police concerned. He further submits that the petitioner is working as Tahsildar of Shayampet Mandal of Hanamkonda/Warangal Rural District and the Police Station, Nennel in Mancherial District is far away from his working place and he is facing much hardship to attend the Police Station as he being an Executive Magistrate of the area, he has to be available to the public and his superior officers around the clock. As he has been complying with the orders passed by this Court, the condition of appearing before the investigating officer may be relaxed.

On the other land, learned Assistant Public Prosecutor submits that investigation is not completed. However, he does not dispute the fact that petitioner has been complying with the conditions imposed by this Court.

Taking into consideration the submissions of both parties, the said condition is modified to the effect that petitioner/A-2 shall appear before the investigating officer

CRL.P.NO.2879 OF 2021 once in a month i.e. on first Sunday of every month between 10.00 am and 5.00 pm till completion of investigation.

The I.A. is ordered, accordingly.
