CVNR,J & ANI S,J A.S.No.536 of 2002 and Cross Objections (sr) No.4289 of 2016 23.01.2017 COMMON JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) The appeal arises out of the order and decree, dated 25.04.1987, in O.P.No.54 of 1985 on the file of the Subordinate Judge, Rajampet. 2.

By a separate docket order passed today, we have dismissed A.S.M.P.No.452 of 2016 filed by the legal representatives of deceased respondent No.10 to come on record. Since the appeal itself is not maintainable against deceased respondent No.10, it is declared that the appeal qua respondent No.10 is non-existent in law and the same is, accordingly, dismissed as such against deceased respondent No.10. 3.

Regarding the other respondents, the learned Government Pleader for Appeals (AP) appearing for the appellant has placed before us, Lok Adalat awards, dated 08.03.2007 and 10.03.2007, passed in respect of the respondents in the appeal mentioned therein and submitted that in view of the said awards, the appellant is not interested in pursuing the appeal.
