SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA W.P.No.24863 OF 2015 ORDER: (Per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed by the petitioners seeking writ of mandamus to declare the action of the respondent bank in not considering the petitioners' representation dated 19.06.2015 for one time settlement to settle the loan accounts as illegal and arbitrary and further direction to the respondent bank to consider the said representation dated 19.06.2015.

The petitioners have obtained loan from the respondent bank but defaulted in repaying the same. It is submitted that the amount due as on 31.07.2015 by the petitioners is Rs.36,71,039/-.

In this writ petition, it is the grievance of the petitioners that though they made a representation on 19.06.2015 to the respondent bank for one time settlement, the respondent bank is not taking any steps. The Chief Manager of Andhra Bank has filed detailed counter affidavit denying the various allegations made in the affidavit. It is stated that as per the one time settlement guidelines, an application is to be made along with 25% of the amount due, but the petitioners have not complied with the said condition.

Learned counsel for the petitioners requested the Court to dispose of the writ petition permitting the petitioners to deposit 25% of the amount due and make an application for one time settlement with a direction to the respondent bank to consider the same.

Having regard to the request made by the learned counsel for petitioners, we deem it appropriate to dispose of the writ petition permitting the petitioners to make an application afresh for one time settlement scheme by paying 25% of the amount due and comply with the conditions as required under the guidelines within two weeks from to day. If any such representation is made by the petitioners, the respondent bank shall consider the same as per the guidelines and take appropriate decision as expeditiously as possible preferably, within a period of four weeks from the date of receipt of the application and communicate the same to the petitioners.

Subject to above, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
