G. Safeer Khan, v. Andhra Pradesh State Waqf Board,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.43381 OF 2016 ORDER:
The grievance of the petitioner is that the 1st respondent issued notification dated 21-11-2016 inviting sealed tenders in respect of items including collection of hundies, (36) rooms and Chandapatti, skin, sugar, jaggery and rice etc., related to the Dargah Hazarath Shaik Shah Vali and Sha Sha Vali (Rh) for a period of three months i.e. from 03-12-2016 to 02-03-2017. In pursuance to the said notification, the petitioner filed tender for Rs.34,53,786/- by paying earnest money of Rs.50,000/- through demand draft. The petitioner became highest bidder for Rs.34,53,786/-. The 1st respondent issued a memo dated 29-11-2016 directing the petitioner to remit the bid amount along with 1% tender expenses in the Board's treasury.
The petitioner submitted representation dated 01-12-2016 stating that due to demonetization of notes, he is unable to pay total bid amount and requested installments for payment of amount. On considering the same, the 1st respondent passed order dated 01-12-2016 to pay the amount in three equal installments i.e.
20-12-2016 and 3rd installment on or before 10-01-2017. On that, the petitioner has deposited an amount of Rs.11,62,774/-towards 1st installment. In pursuance of the order dated 01-12-2016 of the 1st respondent, the 2nd respondent handed over possession in respect of above said items from previous contractor through panchanama on 03-12-2016 in the presence of witnesses. But the 3rd respondent, who is Mutawalli of subject Darga is trying to interfere with the collection of amounts by the petitioner. On that, the petitioner made a representation dated 06-12-2016 to the respondents 1 and 2. But the respondents have not taken action on the same. Aggrieved by the same, the present writ petition is filed.
Heard learned counsel for the petitioner.
Heard learned Standing Counsel for the respondents 1 and 2, who submits that the petitioner's representation will be considered by the 1st respondent within a week.
In view of the facts and circumstances of the case, the 1st respondent is directed to dispose of the representation dated 06-12-2016 filed by the petitioner on or before 22-12-2016 and take action accordingly.
Learned Standing Counsel says that he will inform the 1st respondent about order passed by this Court. With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
