HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.2792 of 2015 in Crl.P.No.2589 of 2015 and Criminal Petition No.2589 of 2015 COMMON ORDER:

The defacto complainant and her counsel Sri Syed Tousif Basha are present. A.1 and A.3 are absent and they are represented by A.8Mohd.Abdul Hamed, who is their Power of Attorney Holder and counsel Sri Mohd. Muzafferullah Khan.

Heard both sides and perused the petitions.

On the report given by the defacto complainant, the Police of Amberpet P.S, Hyderabad registered Crime No.483/2008 and investigated and laid charge sheet against A.1 to A.8 for the offences under Sec.498-A IPC and Sec.3 & 4 of D.P. Act. Charge-sheet was taken cognizance and registered as C.C.No.131 of 2009 by the XIII Additional Chief Metropolitan Magistrate, Hyderabad. While so, the defacto complainant and A.8 who is the GPA of A.1 and A.3 along with their Counsel present in Court today and submitted that at the intervention of elders, they have amicably resolved their disputes whereunder and whereby the complainant and A.1 took divorce and her maintenance claim was also taken care and as such, the defacto complainant has no objection for quashing of proceedings in C.C.No.

131 of 2009 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad and therefore, this Court may be pleased to accord permission to compound the offence and quash the proceedings in the interest of justice. It is further informed that proceedings against A.4 to A.8 are already quashed vide Crl.P.No.11016 of 2010 dated 15.07.2013.

amicably resolved their disputes and want to live separately and peacefully and also considering that no useful purpose will be served even if the parties are driven to trial since they have compromised and following the decision reported in Gian Singh vs. State of Punjab and another, this petition is allowed and permission is accorded to the parties to compound the offence and consequently proceedings in C.C.No.131 of 2009 by the XIII Additional Chief Metropolitan Magistrate, Hyderabad are quashed in the light of joint compromise memo filed by the parties.

In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
