HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL APPEAL No. 979 of 2016 ORDER:

Learned Counsel appearing on behalf of the appellant submits that in view of the recent amendment made to the Criminal Procedure Code, the appellant has to approach the Court of Sessions, however, he wrongly filed the Criminal Appeal before this Court for the issue raised therein. He further submits that the appellant may be given liberty to approach the Court of Sessions within fifteen days and consequential permission to withdraw the present Criminal Appeal.

In view of the aforesaid submission of learned Counsel appearing on behalf of the appellant, permission is granted and the Criminal Appeal is dismissed as withdrawn with liberty as prayed for.

The Registry is directed to return the bundle to learned Counsel for the appellant within three days from today.
