In a suit for partition filed, by them, as far back as the year 1996, the petitioners seek reopening of their evidence purportedly on the ground that a person, who is acquainted with their family for nearly 70 years, has come forward to give evidence.

In my opinion, such a request coming forth from the petitioners cannot be accepted as they were supposed to be vigilant and identify all the persons, whose evidence is material for adjudication of the suit. On the one hand, the public are raising hue and cry for non-disposal of the cases for years on end and on the other hand, the litigants have been coming up with the applications for reopening the evidence. The suit being a 22-year-old one, I find no justification, whatsoever, for reopening the evidence at this stage.

Hence, the Civil Revision Petition is dismissed. As a sequel to dismissal of the Civil Revision Petition, IA.No.1 of 2018, filed by the petitioners for interim relief, is disposed of as infructuous.
