HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6521 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/A1 to A3 under Section 482 Cr.P.C seeking to quash the proceedings in crime No.59 of 2015 of Women Police Station, Rajahmundry Urban, East Godavari District, registered for the offence punishable under Sections 498-A r/w 34 I.P.C and Sections 3 and 4 of the Dowry Prohibition Act.

Heard the learned counsel for the petitioners and the learned Public Prosecutor (Andhra Pradesh) for the State before notice to respondent No.2/de facto complainant and before admission.

The above crime was registered on the report of respondent No.2/de facto complainant. A1 is the husband, A2 is father-in-law and A3 is brother-in-law of the 2nd respondent. Perused the material on record. As the facts fall short for this Court to admit the application under Section 482 Cr.P.C., this application is disposed of giving liberty to the petitioners to surrender before the learned Magistrate and move for regular bail with notice to Additional Public Prosecutor and in such an event the learned Magistrate shall hear and grant bail on the same day with necessary conditions. Needless to say, at the post bail stage pending investigation, the presence of the petitioners before the Court can be dispensed with. In the event of police

filing final report or any cognizance taken by the Magistrate, further remedy is left open to the petitioners.
