Petition filed under Sections 437 & 439 Cr.P.O. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to enlarge lhe Petitioner/A-6 on bail in Crime No. 14 of 2018 of Kasibugga P-S., Srikakulam , dl. 29-1-2018 I The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing lhe arguments of Sri T.M.K. Chaitanya, Advocate for the Petitioner and of Public Prosecutor(AP) on behalf of RespondentState, the Court made the following ORDER :-

SMT. JUSTICE T.RAJANI CRIMINAL PETITION No. 2314 OF 2O1a ORDERT This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking for grant of bail to the petitioner-accused No. 6 in Crime No. 14 of 2018 of Kasibugga Police Station, Srikakulam D istrict.

Heard learned counsel for the petitioner and learned Public Prosecutor (A. P. ).

Learned counsel for the petitioner submits that accused Nos. 1to 5 in this crime were already granted bail by this Court by virtue of order dated 21-02-2018 in Criminal Petition No. 2157 of 2018 and that the petitioner also stands on the same footing as that of accused Nos. 1 to 5. Learned Public Prosecutor does not refute the said submission.

Hence, considering the above, this Court is inclined to grant bail to the petitioner. The petitioner is directed to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned ludicial Magistrate of I Class, Palasa, Srikakulam Dlstrict.
