HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.2542 of 2015 in Crl.P.No.2329 of 2015 and Criminal Petition No.2329 of 2015 COMMON ORDER:

The defacto complainant and her counsel Sri Ravi Kumar are present. Accused and his counsel Sri S.V.Ramana are present.

On the report given by the defacto complainant, the police of Patancheru P.S registered a case in Cr.No.27 of 2015 against the accused for the offences under Sections 448, 354, 323, 504 IPC r/w 3(1)(xi) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and investigation is stated to be pending.

The allegations are that complainant and accused belongs to same locality and on the night of 08.01.2015 when the husband of complainant went to his native place and defacto complainant and her children were in the house watching T.V., the accused entered the house and misbehaved with her. While-so, defacto complainant and accused along with their counsel present in the Court today and submitted that at the intervention of elders, they have amicably resolved all their disputes and they are leading peaceful and harmonious life and hence, defacto complainant has no objection for quashment of proceedings against the accused and therefore, the Court may be pleased to permit the parties to compound the offence and quash the proceedings in the interest of justice.

Having regard to the above said submission and in view of the fact that parties are living in the same locality and they have amicably resolved their disputes and want to live peacefully and harmoniously and considering the fact that no useful purpose will be served even if the investigation is ordered to be continued, and following the decision reported in Gian Singh v. State of Punjab and another, this petition is allowed and permission is accorded to the parties to compound the offence and consequently proceedings in Crime No.27 of 2015 of Patancheru P.S, Hyderabad are

hereby quashed in terms of compromise memo filed by the parties. In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
