HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36269 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in FIR No.207 of 2016 on the file of Raidurgam Police Station, Cyberabad District.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that his wife-deceased took the extreme step for the reason of her ill-health and that the 3rd respondent, who is none other than the father of the deceased, gave statement earlier without making any allegations against the petitioner and subsequently, when he was re-examined by the police, he made several allegations. The petitioner was falsely implicated in the above crime. 4.

The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case and the grievance of the petitioner, this Court is of the view that the investigation can be completed without arresting the petitioner.

Accordingly, respondents Nos.1 and 2 are directed to complete the investigation and file a final report in FIR No.207 of 2016 on the file of Raidurgam Police Station, Cyberabad District, in accordance with law, without arresting the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
