THE HON'BLE SRI JUSTI CE U.DURGA PRASAD RAO CIVIL REVISION PETITION NO.4559 OF 2016 ORDER:

Heard the learned counsel for the petitioner/Jdr and at the admission stage, the CRP is disposed of by the following order. The CRP is filed by the petitioner/Jdr aggrieved by the order dated 23.08.2016 passed in E.A.No.55 of 2016 in E.P.No.38 of 2014 in O.S.No.15 of 2012 on the file of the Senior Civil Judge, Rayachoty, Kadapa District, whereunder the learned Judge directed the petitioner/Jdr to pay instalments at the rate of Rs.50,000/- per month commencing from September 2016 to discharge the EP amount.

Learned counsel for the petitioner would submit the rate of instalments fixed by the Executing Court is burdensome to the petitioner/Jdr and hence, the instalment amounts may be reduced and length of time may be extended.

On perusal of the order impugned, this Court finds no reason to interfere with the same as the order impugned found to be a reasonable one and suffers no illegality.

The Civil Revision Petition is accordingly dismissed at the stage of admission. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand dismissed. ______________________ (U.DURGA PRASAD RAO, J) 23rd September 2016 RRB
