ORDER:
This writ petition is filed for a mandamus to declare the order, dated 15.10.2015, in I.A.No.634 of 2015 in O.P.No.235 of 2014 on the file of the Family Court-cum-Additional District Judge's Court, Nizamabad, as arbitrary and illegal.
At the hearing, Mr.G.Madhusudan Reddy, learned counsel representing Mr.M.Rajender Reddy, learned counsel for the petitioner, has submitted that in view of the recent judgment of the Apex Court in Jogendrasinghji Vijaysinghji vs. State of Gujarath and others[1], the present writ petition is not maintainable and hence, the petitioner may be permitted to withdraw the writ petition to avail any other appropriate remedy.
In view of the above submissions, the Writ Petition is dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made. As a sequel to dismissal of the Writ Petition, interim order, dated 09.11.2015, is vacated and W.P.M.P.No.47127 of 2015 and W.V.M.P.No.4745 of 2015 shall stand dismissed as infructuous. ______________________________ C.V.NAGARJUNA REDDY, J 04th January, 2016 GHN
