THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9574 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused No.18, under Section 438 of the Criminal Procedure Code, seeking anticipatory bail in Crime No.74 of 2016 on the file of Railway Koduru Police Station, YSR Kadapa District, registered for the offences punishable under Sections 147, 148, 353, 307, 379 and 120(B) R/w.149 IPC, 20(1)(C) (ii)(iii)(iv)(vi)(x) and 29(iv)(b) of AP Forest Act and Rule 3 of Sander Wood and Red Sandal Wood Transit Act and 3 of PDPP Act.

The allegations against the petitioner are that he along with the other accused was found committing theft of red Sandal Wood logs. Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and he was falsely implicated in this case.

Learned Additional Public Prosecutor submitted that the petitioner is involved in other cases of similar nature and hence, he is not entitled for anticipatory bail.

In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner.

Hence, the Criminal Petition is dismissed.
