2015-06-24Sanjay Kumar2 pages

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.32703 of 2011 ORDER:

The grievance of the petitioners in this case was that the Station House Officer, I Town Police Station, Nellore was interfering with their life and liberty without following the due process of law.

The Sub-Inspector of Police, I Town Police Station, Nellore filed a counter-affidavit stating that the police authorities never interfered with the life and liberty of the petitioners at any point of time. He further stated that no complaints had been received against them and no criminal cases were registered against them on the file of I Town Police Station, Nellore. He denied the allegation of the petitioners that any call was made to them by the police and asserted that the case seems to have been filed only as a precautionary measure.

The afore-stated stand of the police authorities is taken on record. Needless to state, in the event any complaint is lodged against the petitioners, the police would be bound to follow the due procedure laid down by law in the process of investigating the same and take necessary action, if any, thereafter.

The writ petition is dismissed subject to the above observation.

Pending miscellaneous petitions shall also stand

dismissed. No order as to costs.
