THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE Dr. JUSTI CE SHAMEEM AKTHER WRI T PETI TI ON No.24294 of 2005 ORDER: (per SK,J) This writ petition was filed by a third party to L.G.C.Nos.215 to 220 of 1995 on the file of the Special Court under the Andhra Pradesh Land Grabbing (Prohibition) Act, 1982, Hyderabad. Her complaint however was that pursuant to the judgment dated 24.12.1997 passed by the Special Court in the aforestated L.G.Cs., the revenue authorities were trying to dispossess her and demolish her house in the subject land. By order dated 14.11.2005, this Court directed status quo with regard to the possession obtaining as on that date to be maintained by the parties.
Sri Mohd. Mumtaz Pasha, learned counsel for the petitioner, would fairly concede that he has no instructions as to whether the petitioner separately challenged the judgment dated 24.12.1997 passed by the Special Court in L.G.C.Nos.215 to 220 of 1995. Without levelling a challenge to that substantive order, this writ petition against the consequential action taken by the revenue authorities to implement the said substantive order cannot be maintained. The revenue authorities are bound by the statutory commandment to give effect to the order of the Special Court. Therefore, we find no illegality in the revenue authorities taking steps in that regard in the present case. The writ petition is accordingly dismissed. Interim order dated 14.11.2005 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed.
